Updates since January 2011

MCL 600.5714 was amended by Pub Acts 2012, No. 139. The amendment deleted the words "by the landlord" preceding "alleging that the person" in Section (1)(b); added Section (1)(e) [see below]; and re-designated former (1)(e) through (1)(g) as (1)(f) through (1)(h). The new Section 1(e) states:

"(e) When a person holds over premises for 7 days following service of a written notice to quit for termination of the lease after the tenant, a member of the tenant's household, or a person under the tenant's control, on real property owned or operated by the tenant's landlord, has caused or threatened physical injury to an individual. This subdivision applies only if the police department with jurisdiction has been notified that the person, on real property owned or operated by the tenant's landlord, caused or threatened physical injury to an individual. This subdivision does not apply in either of the following cases: (i) The individual who was physically injured or threatened is the tenant or a member of the tenant's household. (ii) Application would result in a violation of federal housing regulations."

MCL 554.134 was amended by Pub Acts 2012, No. 140. The amendment deleted the words "by the landlord" preceding "alleging that the person" in Section (4).

MCR 4.201(N)(1) was amended to read: "Rules Applicable. Except as provided by this rule, appeals must comply with MCR 7.101 through 7.115."

Local Court Rules: The following LCRs have been rescinded: 27th District LCR 4.201; 36th District LCR 4.202; 55th District LCR 4.201.
